I am writing to ask you to help ensure the security of the chemical industry, one of the most critical parts of this country's infrastructure. 

The members of the American Chemistry Council have taken action to secure their plants.  However, the Department of Homeland Security needs to ensure that all facilities are addressing security as rigorously as ACC members do. 

Please support the adoption of federal legislation that will establish national standards for the security of chemical facilities.  This legislation should require facilities to conduct vulnerability assessments and implement security plans.  It should provide oversight, inspection, and enforcement authority to the Department of Homeland Security to ensure facilities are secure against threats of terrorism.

The United States needs national legislation to avoid a patchwork of laws at the state and local level.  Maryland and New York have already enacted legislation, while other states are considering proposals.  A national approach to chemical plant security is more effective and appropriate.

ACC members have set a benchmark for industry security programs. Appropriate legislation can require DHS to determine if ACC's Responsible Care Security Code qualifies as an alternative compliance mechanism, as was done with the Coast Guard port security regulations.  In this way, DHS can recognize and build on the work ACC companies have already completed.

Please take steps to get meaningful chemical security legislation adopted.
